TERMS AND CONDITIONS

 

GENERAL

 

USE OF IMAGES

 

Any images released to you may be printed or displayed online for personal use only. Selling, publication or any commercial use is prohibited.

 

If you display your images on social media, we ask you to kindly credit our name and/or website where possible, or ‘tag’ the following social media pages respectively (facebook: ‘PAYLOR PHOTOGRAPHY’, instagram ‘@paylorphoto’ and twitter: ‘@paylorphoto’). This is not a contractual requirement, however it is a greatly appreciated gesture.

 

No editing or changes may be made to the digital files supplied. If displayed on instagram, please do not add any filters.

 

We reserve the right to use images for advertising, display, publication and other purposes without seeking permission from you first. All images remain the exclusive property of us Rebecca and Robert Paylor (Paylor Photography).

 

PRIVACY POLICY

 

The processing of personal data, such as the name, address, e-mail address, or telephone number of a data subject shall always be in line with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations applicable to Paylor Photography. By means of this data protection declaration, our enterprise would like to inform the general public of the nature, scope, and purpose of the personal data we collect, use and process. Furthermore, data subjects are informed, by means of this data protection declaration, of the rights to which they are entitled.

 

As the controller, Paylor Photography has implemented numerous technical and organisational measures to ensure the most complete protection of personal data processed through this website. However, Internet-based data transmissions may in principle have security gaps, so absolute protection may not be guaranteed. For this reason, every data subject is free to transfer personal data to us via alternative means, e.g. by telephone.

 

LOCATION

 

Lifestyle shoots within 40 miles of Redcar (TS10) and weddings within 90 miles of Redcar (TS10) will not incur any additional travel charges. 

 

Anything over this will be charged at 45p per mile. 

 

VOUCHERS

 

PAYMENT

 

Vouchers are £150 (unless otherwise stated) and are non refundable. 

 

USAGE

 

Vouchers must be used by the date on the voucher. They are redeemable against one outdoor lifestyle shoot, only.

 

OTHER

 

All other T&Cs relating to lifestyle shoots apply. 

 

 

LIFESTYLE SHOOTS

 

PAYMENT

 

We will invoice you prior to the shoot and payment is due by the date of the photoshoot. Payment on the day is acceptable, however final images will not be made available until the final balance has been paid. 

 

All vouchers are non refundable and must be used by the date printed on the voucher.

 

CANCELLATION

 

All cancellations must be made in writing. We will always attempt to reschedule any cancelled shoot. We reserve the right to refuse to reschedule if a shoot is cancelled the day of the arranged session. 

 

Paylor Photography reserves the right to withdraw services for the following reasons: non-cooperation, changes of locations, missed appointments and/or late or non-payments.

 

 

UNFORESEEN CIRCUMSTANCES

 

In the unforeseen circumstance that we might be unable to work due to illness, accident, injury or other casualty, acts of god/force majeure/unpredictable natural events, or any other cause beyond the control of the parties, we can rearrange the date of the shoot. In the unlikely event we cannot find another suitable date, then liability is limited to a full refund of any payments received or part thereof according to the percentage of images supplied. We cannot be held responsible for lateness due to any public service problems or extraordinary road traffic delays which are beyond our control. It should be noted, however, that we always allow ample extra time when travelling to allow for any delays and every reasonable effort will be made to be on time.

 

We cannot accept liability in the unlikely event that images are lost through theft, fire, equipment malfunction or other damage caused without fault on our part. Liability is limited to a full refund of any payments received or part thereof according to the percentage of images supplied. (please note, we have working methods in place to prevent the loss or damage to your images of professional camera equipment, computer hardware and backup equipment.)

 

In any event, our liabilities are limited to a full refund of any balance paid.

 

SCHEDULE

 

Prior to the shoot we will have discussed our style and approach to lifestyle photography. We cannot guarantee that every shot you may expect or request will be possible on the day. Factors such as weather, location, time availability and subject willingness may interfere with any shot list.

 

We shall be granted artistic licence in relation to the poses photographed, the location used and the group shots taken. Our judgement regarding the location/poses/groups and number of photographs taken shall be deemed correct.

 

It is your responsibility to ensure that certain factors do not significantly interfere with our work. For example, any photography restrictions from shooting locations. Negotiation with the officials for moderation of guidelines will be your responsibility.

 

We reserve the right to cease work and leave in the unlikely event of receiving verbal abuse or feeling threatened in any way.

 

PRODUCTS

 

Lifestyle shoots last around an hour and no longer than 90 minutes.

 

We will return processed images by no later than 4 weeks after the date of the shoot. (please note, 4 weeks is a limit and not a target. We will aim to get your images back to you as soon as possible, however in busy seasons please be prepared to wait the maximum stated duration.)

 

We will provide a pleasing colour balance, but cannot guarantee exact colour matching. This is due to abnormal reflections caused by a combination of certain dyes and materials, especially man-made fibres. (Please note, it is sometimes impossible to record on camera the exact colour as seen by the human eye.)

 

We would encourage all clients to back up their images, as after a 1 year period we can’t guarantee we will still store your images.

 

Any complaints/concerns should be voiced within 7 days of receiving your images. If no feedback is given within this time it will be assumed that you are satisfied with your chosen products.



 

WEDDINGS

 

PAYMENT

 

All weddings require a non refundable booking fee of £200 to secure the booking. This is then deducted from your final balance. The final balance is due 28 days before the date of the wedding. If the wedding date is postponed for any reason the booking fee will be retained and the balance due date adjusted in line with the new wedding date

 

CANCELLATION

 

All cancellations must be made in writing. Cancellations fewer than 4 weeks before the wedding are required to pay full remaining balance. 

 

If a wedding is postponed the balance will be due four weeks before the new date. If postponed to a date we are not available, we will attempt to find an associate shooter. 

 

UNFORESEEN CIRCUMSTANCES  

 

In the unforeseen circumstance that we might be unable to work due to illness, accident, injury or other casualty, acts of god/force majeure/unpredictable natural events, or any other cause beyond the control of the parties, Paylor Photography will make every effort to arrange a substitute photographer with a similar shooting style and camera bodies/lenses.

 

Under normal circumstances one member of Paylor Photography will shoot the day on his/her own. If both photographers are unavailable and a replacement photographer cannot be found then liability is limited to a refund of any payments received or part thereof according to the percentage of images supplied. 

 

We cannot be held responsible for lateness due to any public service problems or extraordinary road traffic delays which are beyond our control. It should be noted, however, that we always allow ample extra time when travelling to allow for any delays and every reasonable effort will be made to be on time. We cannot accept liability in the unlikely event that images are lost through theft, fire, equipment malfunction or other damage caused without fault on our part. SCHEDULE

 

Prior to the wedding we will discuss and arrange a priority list of desired shots and a running order of the day and we will make every effort to ensure any specific shot list is fulfilled. However, we cannot guarantee that every shot will be possible on the wedding day.  Photographs taken during the course of the event will be at the discretion of Paylor Photography. No responsibility will be taken by Paylor Photography on the occasion that any specific shot is overlooked.  You (the couple) are the client and we will prioritise your list of desired shots only. Any requests for photographs from others attending the wedding may be politely dismissed if time does not allow.  

 

We will request a specific list of group photographs ‘family formals’ prior to the wedding day. We will be as accommodating as possible but we may advise you, the clients, on the number of shots requested and limit the number requested if we feel it will interrupt and/or compromise the rest of your coverage. No responsibility will be taken by Paylor Photography for missing family photos due to lack of willingness of the subject or constraints placed upon us by the venue.

 

We will be the only official photographers at your wedding. Any guests with any cameras, whether at professional or amateur level, must not interfere with our work.  We will require time alone with you for portraits. Requests from others to join us during this time will be politely dismissed.  We shall be granted artistic licence in relation to the poses photographed, the editing and processing of images, the location used and the group shots taken. 

 

Our judgement regarding the location/poses/groups/editing/retouching and number of photographs taken shall be deemed correct and final. Any further editing or retouching will be done at the discretion of Paylor Photography and may incur additional fees.  

 

It is your responsibility to ensure that certain factors do not significantly interfere with our work. For example, any photography restrictions from wedding officiants or management of the reception location. Negotiation with the officials for moderation of guidelines will be your responsibility.  A meal (not necessarily the same wedding breakfast that you will be having) must be organised during your own wedding breakfast to ensure that we have time and energy to shoot after eating time is over.  

 

We reserve the right to cease work and leave in the unlikely event of receiving verbal or physical abuse, harassment or if we feel threatened from you the clients, guests or suppliers.  

 

PRODUCTS  

 

Wedding day coverage is from pre-wedding preparation (two hours before the ceremony time unless otherwise agreed) to either the end of speeches or a few songs after the first dance (unless otherwise agreed).  For any photography coverage and products, full creative freedom shall be granted. Our editing, image selection and processing is final. Any additional processing requested may be subject to an additional fee and completed at the discretion of Paylor Photography.  

 

We will return processed images to you no later than 8 weeks after the date of the wedding. (please note, 8 weeks is a limit and not a target. We will aim to get your images back to you as soon as possible, however in busy seasons please be prepared to wait the maximum stated duration.)  We will provide a pleasing colour balance, but cannot guarantee exact colour matching due to a number of factors, in particular when working with artificial or changeable lighting on the day. (Please note, it is sometimes impossible to record on camera the exact colour as seen by the human eye.)  

 

We would encourage all clients to back up their images, as after a 1 year period we can’t guarantee we will still store your images.  Any complaints/concerns should be voiced within 14 days of receiving your images. If no feedback is given within this time it will be assumed that you are satisfied with your chosen coverage and products.
